Housing Rights of Disabled Tenants?

Does a employee have the right to use the only Handicap parking space at the office.She does have a disabled license plate, but there is only one space to park while we get our mail, pay rent etc. She is there from 9AM to 6PM and also has a reserved office manager space. We have to walk around several parked cars and sometimes there are no spaces.

Yes, she has every right to park there. But the office certainly isn't not very tenant friendly that she uses it all time.

I would park directly behind her - since you know she is working and won't be moving.

as long as teh spot isn't specifically reserved fro a specific person–anyone–including an office employee with a tag–can use the spot….how far away is the manager space–if she is not using the manager space–maybe they can make that a tenant space- or 2nd handicap spot….

or call inside when you get there–tell them since there isn'at good access for you–tell them they will need to come out to conduct business curbside

I'm assuming she is actually the person the plate is assigned to–and it doesn't belong to her mother or other fmaily member

Yes, if she has a disabled license plate she is allowed to park in the handicapped space.

Her reserved manager space should suffice. Top ofc ppl are generally allotted spaces pretty close to the entrance. She can park in handicap places w/her disabled license plate elsewhere (legally can here at work, but not ethically), but the space is designed for tenants & their visitors. Is there a management company with which you can voice a complaint? If not, perhaps your city council, housing authority, ctr for sr citizens & disabled. The next rung would be state govt…representatives and governor.

Of course, after the first complaint with the mgmt co, you could contact the local media….sometimes that gets things moving surprisingly quickly & effectively. One must be aware that if she plays with the big dogs, she might get dirty in her reactions…so there could be repercussions for you. But you have laws and the ADA on your side, as well. If more than one person from the housing units complained about the situation, the better it would be.
